Plastic Surgery - Do i Bring A Lawsuit On My Surgeon If That he or she Destroyed My Breasts?


Q: I just had a breast implants put in and I don't like the way they came out. Can I bring a lawsuit against my plastic Surgeon if the he won't fix them totally free of charge?

A: There are two issues here. The first is your unhappiness with due to the breast implants. The second is if you could sue if not repair the first result for free.

First- the fact you had breast implants suggests that you are not satisfied with your appearance to begin with. Breast implant and nylon Surgery cases are inherently bad cases for me to take because they insure subjective feelings, opinions and impressions in the patient. Specifically, the patient is not going to happy with how they appear initially, and after accomplishing this, they are still not happy with the result. Just as you are unsatisfied with the breast Surgery results does not always mean that there was resistant malpractice.

There are always risks consisting of any Surgery. I am confident your plastic Surgeon gave you a detailed form called completely Consent sheet that described the operation. You may have actually been given brochures or periodicals describing the risks, benefits and alternatives to this breast Surgery you wanted to have. Again, I feel that since you went forward and with the Surgery, you signed this consent and came to the realization there was a possibility the outcome aren't perfect.

The second point is that you must address your displeasure in your plastic Surgeon. There are times when the doctor will agree to reflect upon revise the procedure at no cost to you. At other times the doctor believes they might did a good step, but other factors caused the poor outcome, and he aren't agreeable to revise accomplishing this for free.

Remember, you get to bring a lawsuit, but the question is whether your case definitely needs merit, and whether it is financially in your best interest and your attorney to proceed.

In my opinions, I do not grasp plastic Surgery cases unless you will notice, based upon expert attention review, that there are departures from health care (not just that the consumer is unhappy with the consequence of their boob job, if not nose job), that the departures were a substantial factor in causing break, and that the harm is permanent.
